1. Introduction

Multiverse Tools ("Multiverse Tools," "we," "us," or "our") is committed to respecting intellectual property rights and expects all users of our website and services (collectively, the "Service") to do the same. This DMCA Policy outlines the procedures we follow to address claims of copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

If you believe that your copyrighted work has been copied, reproduced, or distributed in a way that constitutes copyright infringement and is accessible through our Service, please notify our Designated Copyright Agent as set forth below.

2. Reporting Copyright Infringement (Filing a DMCA Takedown Notice)

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

What Your Notification Must Include:

To be effective, your DMCA notification must be a written communication that includes substantially the following (please refer to 17 U.S.C. § 512(c)(3) for further detail):

  • A. Identification of the Copyrighted Work:

    A clear identification of the copyrighted work(s) you claim has been infringed. If multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

  • B. Identification of the Infringing Material:

    A clear identification of the material that you claim is infringing or is the subject of infringing activity, and that is to be removed or access to which is to be disabled. Please include information reasonably sufficient to permit us to locate the material. Providing specific URLs in the body of an email is the most effective way to help us locate content quickly.

  • C. Your Contact Information:

    Information reasonably sufficient to permit us to contact you, such as your full legal name, mailing address, telephone number, and, if available, an email address.

  • D. Statement of Good Faith Belief:

    A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. (e.g., "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).")

  • E. Statement of Accuracy (Under Penalty of Perjury):

    A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. (e.g., "I hereby state that the information in this notification is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.")

  • F. Your Signature:

    A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important: Incomplete or improperly formatted DMCA notices may result in a delay in processing or may be considered invalid. Knowingly misrepresenting that material is infringing may subject you to liability for damages, including costs and attorneys' fees.

3. Submitting Your DMCA Notification

We recommend sending notifications via email for the quickest processing. For security reasons, email attachments may be filtered; please include all information directly in the body of the email if possible.

4. Our Response to Infringement Claims

Upon receipt of a valid and complete DMCA Notice, Multiverse Tools will take whatever action, in its sole discretion, it deems appropriate, including:

  • Removing or disabling access to the allegedly infringing material.
  • Notifying the user who posted or provided the material that we have removed or disabled access to it.
  • In appropriate circumstances, terminating the access of users who are determined to be repeat infringers.

5. Counter-Notification Procedure

If you believe that material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting a written notification to our Designated Copyright Agent (identified in Section 3).

What Your Counter-Notification Must Include:

Pursuant to the DMCA, the Counter-Notice must substantially include the following:

  • A. Your Signature:

    Your physical or electronic signature.

  • B. Identification of Removed Material:

    An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.

  • C. Statement of Good Faith Belief (Under Penalty of Perjury):

    A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.

  • D. Your Contact Information:

    Your name, address, telephone number, and, if available, email address.

  • E. Consent to Jurisdiction:

    A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Multiverse Tools may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

What Happens After a Counter-Notification is Filed:

If a valid Counter-Notice is received by the Designated Copyright Agent, Multiverse Tools may, in its discretion, send a copy of the Counter-Notice to the original complaining party. This informs them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at Multiverse Tools's sole discretion.

Important: Knowingly misrepresenting that material was removed or disabled by mistake or misidentification may subject you to liability for damages, including costs and attorneys' fees.

6. Repeat Infringer Policy

It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts or access of users who are repeat infringers of copyrights or other intellectual property rights of others.

7. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. We encourage you to review this policy frequently. If we make material changes to this policy, we may notify you on our Service, by a blog post, by email, or by any method we determine. The method we choose is at our sole discretion. We will also change the "Last Updated" date at the beginning of this policy. Any changes will be effective immediately upon posting of the revised policy.
